Member: A person who provides information to the Company to participate in the Service as a paid member.
User or Potential Match: A person who provides information to the Company to participate in the Service as a free match (e.g., “Are You The One” matches).
You / Your: Any person using the Website or Services in any capacity.
These Terms apply to all use of the Website and Services, including any correspondence by email, phone, or other means between you and Gayquation.
This Agreement is an electronic contract that sets out the legally binding terms for your use of the Website and Services.

We may change, alter, or modify these Terms at any time. Changes become effective when posted on the Website. Your continued use of the Website or Services after changes are posted constitutes your acceptance of the updated Terms. It is your responsibility to review the Terms periodically.
By using the Website, registering an account, becoming a Member, or purchasing/accepting any Services, you acknowledge that you:
Have read, understand, and agree to these Terms;
Agree to our Privacy Policy and Cookie Policy, Dating Safely Tips, and any applicable LTR Guarantee terms; and
Agree to any additional terms disclosed to you when purchasing or accepting specific services.
If you do not agree to all of the above, do not use the Website or Services.
You must be at least 18 years old to access or use the Website or Services. Access or use by anyone under 18 is strictly prohibited.
By using the Website or registering, you represent and warrant that:
You are 18 years of age or older;
You have the right, authority, and capacity to enter into this Agreement;
You are legally unmarried;
You will use the Website in compliance with all applicable laws and regulations; and
You have not been convicted of a felony and are not required to register as a sex offender with any government authority.
Membership is void where prohibited. Gayquation reserves the right to refuse service to anyone for any reason or no reason.
You may register as a free Potential Match, but free registration does not entitle you to member contact details or guaranteed matches.
To access full matchmaking and related features, you must become a paid Member and pay the fees listed in our then-current price list (which forms part of this Agreement). We may change fees at any time.
By registering, you agree to:
Provide accurate, current, and complete information as prompted in your profile (“Account Profile”);
Update your information as needed to keep it accurate, current, and complete;
Submit at least one recent, true-to-life photograph (taken within the past 3 months) of yourself. You understand that:
Submitting no or inaccurate photos may delay matchmaking timelines;
Marketing of members and third-party acceptance of your profile may be affected without a valid photo.
You agree that we may rely on your registration data as accurate and complete. If your data is untrue, inaccurate, not current, or incomplete, we may terminate your membership and/or access to the Services without refund.
Right to Exclude
Gayquation may reject any registration, or terminate any account, at its sole discretion and may refund fees in full or in part as it sees fit. We reserve the right to deny participation in any Gayquation event or service.
Approval of an application does not guarantee that a membership position, program placement, pricing, or enrollment opportunity will remain available indefinitely.
During this activation period, Gayquation may reserve staffing resources, interview scheduling capacity, and program availability on the applicant's behalf.
If an approved applicant does not activate the approved membership within three (3) calendar days after receiving the approval or activation notice, Gayquation may remove the temporary membership reservation, release the reserved position, allow the approval to expire, or require the applicant to submit a new application and complete a new internal review.
Any extension of the activation period must be approved by Gayquation in writing. If an applicant is required to reapply, approval is not guaranteed, and the applicant may not receive the same membership terms, pricing, availability, program eligibility, promotional offer, or team assignment previously offered.
By becoming a Member, you elect to commence services immediately and waive any “cooling-off” period that might otherwise apply under applicable law.
This Agreement remains in effect while you use the Website or Services and continues to apply after your membership ends, including provisions relating to dispute resolution, indemnification, payment obligations, limitations of liability, and any provisions intended to survive termination.
All member rights relating to cancellation, early termination, refunds, membership holds, and any applicable exceptions are governed by Section 19 of these Terms, the applicable Membership Agreement, the applicable LTR Guarantee, and applicable law.
Gayquation may suspend or terminate your membership or access to the Website or Services at any time if we reasonably believe you have violated these Terms, your Membership Agreement, engaged in fraudulent, abusive, unlawful, threatening, harassing, or inappropriate conduct, provided false or misleading information, initiated a fraudulent chargeback, compromised the safety or integrity of our Services or Members, or for any other reason permitted by these Terms or applicable law.
Refunds on Termination
Your use of the Services is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By registering or using the Services, you agree to the collection, use, and disclosure of your information as described therein.
While we use reasonable safeguards, we cannot guarantee absolute security of data transmitted over the Internet. You agree to release Gayquation and its affiliates from claims arising out of third-party access to information you provide, to the fullest extent permitted by law.
If you are a California resident, you waive California Civil Code Section 1542, which states:
“A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”
You agree that any comments, ideas, suggestions, concepts, reviews, techniques, or other material you submit to us (“Feedback”), including responses to questionnaires and postings on the Website, may be used by Gayquation worldwide and in perpetuity, without compensation, for any purpose, including:
Developing, improving, and marketing services
Creating or modifying products and features
To the extent permitted by law, you waive any “moral rights” in such Feedback.
Gayquation does not accept unsolicited ideas for TV shows, movies, etc. If you submit such material, you do so with the understanding no additional consideration will be given, even if similar content is later produced.
The Services may not be accessed or used where prohibited by law.
You understand that, through the Services, you may encounter content or behavior deemed mature, offensive, indecent, or otherwise objectionable. This may result from interactions with other users or members.
YOU ASSUME ALL RISK arising from use of the Services, including online and offline communications and in-person meetings (such as dates). You are solely responsible for exercising caution and taking all necessary safety precautions when interacting with people you meet through Gayquation.
You are solely responsible for your interactions with other users and members.
We have no obligation to:
Screen users or members;
Inquire into their backgrounds; or
Verify statements made by users or members.
We make no warranties regarding the conduct, intentions, or compatibility of users and members. We may, but are not obligated to:
Monitor disputes between users;
Block or terminate members for violations;
Conduct background checks using publicly available records.
If you find another user’s content offensive or harmful, you may use any reporting tools we provide.
Release of Claims
In the event of a dispute with one or more users or members, you release Gayquation, its affiliates, officers, directors, employees, and agents from all claims and damages of any kind arising from such disputes.
If you are a California resident, you again waive California Civil Code Section 1542 as quoted above.
Gayquation does not guarantee that:
You will receive a particular number of matches;
You will meet or date any specific person;
Any match will lead to a relationship; or
Any relationship outcome will result from introductions or events.
Some aspects of the Services are designed, in part, for amusement and entertainment.
Gayquation strives to provide a safe, non-invasive environment and upholds the integrity of its services.
We may conduct a preliminary soft profile check, which can include:
Verifying identity via public or third-party profiles;
Verifying photos as authentic;
Verifying location via IP or similar tools;
Verifying contact information;
Conducting certain criminal background checks, where permitted.
However, Gayquation does not comprehensively verify:
Employment or education;
Full criminal history or sex offender registries, except where specifically indicated;
Credit or other background checks beyond what is explicitly described.
You acknowledge that it is your sole responsibility to conduct any additional checks you deem necessary before meeting or engaging with another person.
Members agree to:
Conduct themselves respectfully during and after dates, workshops, and events;
Provide feedback to Gayquation after an Insta-Date or first date if they are using Momentum or related services.
Gayquation has no responsibility for the outcome of any relationship that may form from an introduction or event.
You agree to promptly report any violations of these Terms by others.
Gayquation reserves the right, but not the obligation, to monitor, remove, or edit any content submitted or posted on the Services if we believe it violates the law or these Terms, or is otherwise objectionable.
You will not provide inaccurate, misleading, or false information to Gayquation or its users. If your information becomes inaccurate or misleading, you must promptly update it or notify Gayquation.
We may use your email and/or phone number to:
Send important updates about the Services;
Seek or confirm your permission for introductions;
Notify you of special offers (subject to applicable consent).
You are responsible for:
Maintaining the confidentiality of your email, username, and password;
Restricting access to your account;
Notifying us promptly of any unauthorized use.
If you share your password or payment details, you understand that others may be able to alter or access your account. You are responsible for all activities conducted under your account.
Gayquation offers customer support, coaching, webinars, and educational content. These are:
For informational and entertainment purposes only;
Not a substitute for professional medical, psychological, or therapeutic treatment.
You acknowledge that Gayquation and its staff are not licensed doctors, nurses, psychologists, or therapists.
When communicating with customer service or matchmakers, you may not engage in abusive, obscene, offensive, threatening, or harassing behavior. We may record calls for quality assurance. If your conduct is inappropriate, we may immediately terminate your access without refund.
You may send comments, complaints, or success stories to info@gayquation.com. Success stories and testimonials may be used in marketing without compensation.
You agree to pay all charges incurred in connection with your Billing Account using your selected payment method (“Payment Method”). We may correct any billing errors even after requesting or receiving payment.
If you initiate a chargeback on a legitimate charge, we may terminate your account immediately. If the dispute is resolved in our favor, your account may remain closed and you are not entitled to reinstatement or refund.
Fraudulent chargebacks (reversing legitimate charges) are prohibited. We may cooperate with payment processors, banks, and law enforcement by providing evidence of the transaction, communications, and membership history.
Paid memberships are offered on fixed-term plans or other defined packages as presented at the time of purchase. Gayquation does not currently offer month-to-month memberships.
An approved application does not become an active paid membership until the applicant completes the required activation and payment process. Any temporary membership reservation may expire in accordance with Section 5.1, Application Approval and Activation Period.
Unless expressly stated in your individual agreement or order terms, memberships do not automatically renew. You agree to pay all fees associated with the membership term or package you selected.
You must keep your Billing Account information current and accurate. If your payment method fails, we may suspend or terminate your membership, or continue attempts to process payment. Upon successful payment, your membership may resume in accordance with the terms of your agreement.
You may request to place your membership on hold by contacting support@gayquation.com or your matchmaker. Holds commence from the date of notification. You must notify us when you wish to lift the hold.
This Refund and Guarantee Policy applies to Gayquation's current 6-month, 12-month, and 24-month fixed-term Long-Term Relationship (LTR) programs. It must be read together with your Membership Agreement, order terms, checkout disclosures, and the applicable Long-Term Relationship Guarantee.
For additional information regarding eligibility requirements, qualifying relationships, exclusions, participation obligations, and available remedies, please review the Gayquation LTR Guarantee.
LTR Program: A fixed-term 6-month, 12-month, or 24-month professional matchmaking engagement offered by Gayquation.
Membership Agreement: The written enrollment agreement, order summary, invoice, checkout terms, or other membership-specific terms accepted by the Member.
LTR Guarantee: The relationship-based guarantee applicable to an eligible LTR Program, including the terms published at gayquation.com/guarantee and any membership-specific guarantee disclosures provided at enrollment.
A refund request may be considered only if it is submitted promptly after enrollment and before substantial services have commenced. Services may be considered commenced once Gayquation has begun, reserved, allocated, delivered, or made available any intake, application review, assessment, interview preparation, interview, profile development, strategy work, market analysis, coaching, Momentum, candidate research, matching activity, platform benefits, staffing, or other included service.
All refund requests must be submitted in writing through Gayquation Customer Service. Any refund right remains subject to the disclosures provided at enrollment, the applicable Membership Agreement, and applicable law.
Once services have commenced, the membership is non-cancellable and non-refundable before completion of the agreed fixed term, except where expressly required by applicable law, expressly provided in the Membership Agreement or applicable LTR Guarantee, or approved in writing by Gayquation in extraordinary circumstances.
Services and resources that may be non-refundable once commenced, delivered, reserved, allocated, or made available include:
Application review, intake, interview, and compatibility assessment;
Profile development, search strategy, and market analysis;
Matchmaker time, candidate research, screening, outreach, and matchmaking efforts;
Coaching, Momentum, reports, platform tools, events, and other included or bundled benefits; and
Administrative, staffing, technology, marketing, and operational resources allocated to the Member's program.
A Member's decision not to use, access, or participate in available services does not make those services refundable and does not reduce fees owed for the complete fixed term.
Gayquation offers fixed-term LTR Programs of 6 months, 12 months, and 24 months. Each program is purchased as one complete professional service engagement rather than as a series of monthly memberships.
Paying in installments is a payment arrangement only. It does not create a month-to-month membership, a monthly cancellation right, or a right to stop paying before the total program fee has been satisfied.
The selected program may not be shortened, converted to another term, or ended early unless Gayquation expressly agrees in writing or applicable law requires otherwise.
An approved hold pauses services only as stated in Gayquation's written approval or the Membership Agreement. It does not automatically cancel the membership, forgive payment obligations, or create a refund right.
Eligible LTR Programs may include a relationship-based guarantee. The applicable eligibility requirements, definition of a qualifying relationship, participation obligations, exclusions, and remedies are governed by the Membership Agreement, enrollment disclosures, and the Gayquation LTR Guarantee.
The guarantee applies only to the qualifying LTR Program identified in the Member's enrollment documents.
Eligibility may require completion of the full program term, completion of intake and interviews, maintenance of an accurate profile, timely responses, reasonable availability, feedback, and good-faith cooperation with the matchmaking process.
Any approved remedy may include an extension of service, membership credit, partial refund, full refund, or another resolution expressly provided by the applicable guarantee.
No guarantee remedy is evaluated or becomes due before completion of the entire agreed program term unless the Membership Agreement or applicable guarantee expressly states otherwise.
The LTR Guarantee may be updated from time to time to clarify eligibility requirements, administrative procedures, examples, or operational processes. Material changes will not retroactively reduce any guarantee already applicable to an active Membership unless otherwise permitted by law or expressly agreed to by the Member.
Gayquation's LTR Programs are designed and priced as fixed-term professional service engagements. By enrolling, the Member acknowledges that the entire 6-month, 12-month, or 24-month term is an essential part of the Service and provides Gayquation with the reasonable time and opportunity required to perform its obligations and pursue the intended relationship outcome.
Professional matchmaking is an evolving and highly personalized process. The agreed term gives the matchmaking team the necessary runway to gather market feedback, evaluate outcomes, assess responses, refine criteria, adjust strategy, expand search parameters where appropriate, and optimize efforts as new information and compatible candidates become available.
The team may modify its approach throughout the program, including making quarter-over-quarter and other periodic adjustments based on the Member's feedback and participation, prior outcomes, changing market conditions, candidate availability, and other relevant information. Ending the program early would prevent Gayquation from completing this iterative process and having the full contracted opportunity to optimize its efforts.
The LTR Guarantee also requires Gayquation to assume substantial performance and financial risk. Depending on the applicable guarantee, Gayquation may be required to provide additional services without further payment, extend a membership at no charge, issue a credit, or provide a partial or full refund. This may result in Gayquation performing substantial additional work without additional compensation. In exchange for Gayquation assuming that risk, the Member agrees to provide the entire contracted timeframe before any guarantee or refund remedy is evaluated.
Accordingly, after services have commenced, a Member may not voluntarily cancel, terminate, suspend, shorten, stop payment for, or request an early refund of the program before the complete agreed term has concluded, except where expressly required by applicable law or approved in writing by Gayquation in extraordinary circumstances.
Beginning a relationship through Gayquation or independently, relocating, changing preferences, experiencing a change in personal or financial circumstances, declining introductions, ceasing communication, or choosing not to participate does not automatically end the fixed term, eliminate amounts owed, or create a right to an early refund.
If a refund is approved under the applicable Membership Agreement, LTR Guarantee, these Terms, or applicable law, Gayquation may process it within the timeframe and by the payment method stated in the applicable program terms. Where permitted by the applicable agreement and law, an approved refund may be issued in up to eight (8) monthly installments.
Unless otherwise confirmed in writing, approval of a refund does not modify or waive any eligibility requirement, condition, release, continuing obligation, or other term attached to that refund.
Gayquation values transparency and fairness. When an approved refund is processed in installments rather than as a single lump-sum payment, the structure allows Gayquation to responsibly honor the approved refund while continuing to fulfill its commitments to active members and maintain the resources required to operate its professional matchmaking services.
Keep Eligible Services Active: Where applicable and expressly approved in writing, a Member's services may remain active while an approved refund is being processed so the Member does not unnecessarily lose access to potential opportunities or included support.
Maintain Consistency and Quality: Spreading an approved refund over several months helps Gayquation continue providing ongoing matchmaking, coaching, technology, and support without disrupting service quality for active Members.
Balance Operations and Honor Commitments: Installment-based refunds help Gayquation support dedicated matchmakers and staff, maintain technology and operations, and satisfy approved refund obligations responsibly and sustainably.
Account for Resources Already Allocated: Gayquation commits staffing, administrative, technology, marketing, coaching, and matchmaking resources throughout each fixed-term program. Installment processing recognizes those ongoing commitments while ensuring an approved refund remains scheduled and documented.
The number, amount, and schedule of refund installments will be stated in the written refund approval or determined under the applicable Membership Agreement and guarantee terms. Refund installments do not constitute a new membership, financing arrangement, or waiver of any other provision of these Terms.
No refund is provided for an unused portion of a program merely because the Member establishes a relationship through Gayquation or outside Gayquation.
No refund is created by dissatisfaction with a particular candidate, a candidate's decision not to proceed, the absence of a specific result within a preferred timeframe, or circumstances outside Gayquation's reasonable control.
Gayquation does not guarantee the availability, interest, responsiveness, conduct, or relationship decisions of any particular person.
Any exception, refund, credit, hold, extension, or other remedy must be confirmed by Gayquation in writing.
The Member's Membership Agreement, these Terms of Service, and the applicable LTR Guarantee collectively govern the membership. In the event of any inconsistency, the more specific document governing the Member's purchased program shall control to the extent permitted by applicable law. The Privacy Policy and Cookie Policy and Dating Safely Tips also apply to the Member's use of the Website and Services.
If a conflict exists, the Membership Agreement controls with respect to the Member's specific program, pricing, term, and guarantee, to the extent permitted by applicable law. If the Membership Agreement does not address the issue, these Terms control. The published LTR Guarantee supplements these Terms but does not expand or replace membership-specific restrictions unless expressly incorporated into the Membership Agreement.

The Services are for personal, individual use only. You may not:
Use the Website or Services for any commercial, business, or organizational purpose;
Advertise or solicit anyone to buy or sell products or services;
Send chain letters, junk mail, or spam;
Use information obtained from the Services to contact other users for commercial purposes without their explicit consent.
If you send unsolicited bulk communications (“spam”) through the Services, you agree that Gayquation may seek statutory penalties and damages, and you agree to pay Gayquation $50 per unsolicited communication as a reasonable estimate of harm, in addition to all other legal remedies.
You may create only one unique profile and must use the Services only for bona fide relationship-seeking purposes.
Gayquation may:
Match you with individuals within or outside its membership database;
Offer free introductions (e.g., “Are You The One” matches);
Use algorithms, demographics, criteria, and preferences in match selection;
Screen profiles within the scope of GQ Protect.
You are under no obligation to meet any match. We may create test profiles for quality and monitoring purposes.
You may not harass, threaten, or intimidate any Gayquation employee, contractor, or agent. We may terminate your account immediately if you do so.
We may disclose information you provide if:
Required by law or legal process;
Necessary to protect Gayquation’s or others’ rights or property;
Necessary to protect someone’s health or safety;
We suspect abuse (e.g., domestic, child, elder abuse, or neglect) and deem it appropriate to contact authorities.
You consent to such disclosures where permitted by law.
By using the Services, you agree that Gayquation may use anonymous, aggregated information about you and your experience to conduct research, improve the Services, or publish findings (e.g., in academic journals). Your personally identifiable information will not be disclosed in such publications.
The Website may contain links to third-party websites, ads, or resources. Gayquation:
Does not endorse or control these third-party sites;
Is not responsible for their content, privacy practices, or any losses or damages arising from your use of them.
You should review the third party’s own privacy policy before providing any personal information.
Any advice, opinions, statements, or other content provided by third parties (including users) are solely those of their authors. We do not guarantee their accuracy or endorse them, and you rely on them at your own risk.

WE ARE NOT RESPONSIBLE FOR THE CONDUCT, ONLINE OR OFFLINE, OF ANY USER OR MEMBER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
GAYQUATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR SERVICE INTERRUPTIONS.
WE SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM THE CONDUCT OF YOU OR ANY OTHER USER, INCLUDING BODILY INJURY OR EMOTIONAL DISTRESS RESULTING FROM MEETINGS OR COMMUNICATIONS.
YOU AGREE TO INDEMNIFY AND HOLD GAYQUATION AND ITS AFFILIATES HARMLESS FROM ANY CLAIMS, LOSSES, LIABILITIES, OR EXPENSES (INCLUDING ATTORNEYS’ FEES) ARISING FROM:
Your breach of these Terms;
Your content or communications;
Your use of the Website or Services; or
Your violation of any law or third-party rights.
Content you post or submit through the Services may be visible to others and is considered non-confidential. By posting content, you grant Gayquation a worldwide, perpetual, irrevocable, sublicensable license to use, reproduce, modify, distribute, display, and create derivative works from such content for any purpose connected with the Services.
You may not:
Harass or harm other members using information obtained from the site;
Promote prostitution, escort services, “sugar daddy/money slave” arrangements, or any exchange of sexual services for payment;
Reference such arrangements in your username, profile, or communications.
Gayquation may remove any content, including photos, that it deems misleading, inappropriate, or unreasonably unrepresentative (e.g., professional or edited images that do not reflect your real-life appearance).
All site content, trademarks (“Gayquation,” “333 Rule,” “Gayquotient,” “Insta-Match,” etc.), and proprietary material are owned by or licensed to Gayquation and may not be used without our prior written consent.
These Terms, together with the applicable Membership Agreement, LTR Guarantee, Privacy Policy and Cookie Policy, Dating Safely Tips, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Gayquation regarding the Website and Services.
If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision shall not be a waiver of that provision or any other.
